By using the website(s) https://dyvy.tv/, https://ctv.dyvyapp.com/, https://mobile.dyvyapp.com/ and all subdomains of https://dyvy.tv/, https://ctv.dyvyapp.com/, https://mobile.dyvyapp.com/ (hereinafter referred to as the «Website»), and/or the DyvyTV software application for Smart TV (hereinafter referred to as the «Software Application») for viewing free television on the DyvyTV OTT platform (hereinafter referred to as the «Platform»), which are administered by UKR-BUSINESS 2000 LLC, a limited liability company duly incorporated and operating under the laws of Ukraine (01001, Kyiv, 13 Prorizna Street, premises 77, office 11) (hereinafter referred to as the «Company»), I (hereinafter referred to as «I», «User»):
- accept the User Agreement;
- grant my consent to the Company for the processing of my personal data (hereinafter referred to as the «Consent») and confirm that I am familiar with the purpose of personal data processing and with the rights granted to me pursuant to Article 8 of the Law of Ukraine “On Personal Data Protection” (hereinafter referred to as the «Law»).
Purpose of Processing and Types of Data
Processing of personal data means any action or set of actions, such as collection, registration, accumulation, storage, adaptation, modification, renewal, use and dissemination (distribution, sale, transfer), anonymization, destruction of personal data, including through the use of information (automated) systems (Article 2 of the Law).
The purpose of processing the User’s personal data is to ensure the ability to:
- provide the User with access to the Platform via the Website and/or the Software Application and to administer such access;
- personalize and adapt the User’s experience on the Platform via the Website and/or the Software Application, including by targeting advertising materials;
- analyze the use of the Platform via the Website and/or the Software Application in order to improve interaction with the User;
- ensure the ability to send advertising and marketing communications (including SMS messages, messengers, push notifications) in order to inform the User about news and other marketing activities that may be of interest to them.
To achieve the above processing purposes, the User data collected on the Platform via the Website and the Software Application may include:
- the User’s contact details, including a mobile phone number, in the event of authorization (registration) and for marketing activities;
- information collected automatically (IP addresses and operating systems of devices from which the Platform is accessed via the Website and/or the Software Application, geolocation data, type and version of the web browser, links used by the User to access the Website and the Software Application, User activity on the Website and in the Software Application, links followed by the User after visiting the Website, and cookie files).

In addition, I agree that a separate legal basis for the provision of certain types of services under the User Agreement may be the conclusion and performance of transactions with me, according to which the list of my personal data subject to processing may be expanded.
Rights of the Personal Data Subject
I confirm that I am familiar with my rights as a personal data subject as provided for in Article 8 of the Law, namely the right to:
- know the sources of collection, the location of my personal data, the purpose of their processing, and the location or place of residence (stay) of the owner or processor of personal data, or to authorize a designated person to obtain such information, except in cases established by law;
- receive information about the conditions for granting access to personal data, including information about third parties to whom my personal data is transferred;
- access my personal data;
- receive, no later than within 30 (thirty) calendar days from the date of receipt of the request, except as otherwise provided by law, a response as to whether my personal data is being processed and to receive the content of such personal data;
- submit a reasoned request to the owner of personal data objecting to the processing of my personal data;
- submit a reasoned request for the modification or destruction of my personal data by any owner or processor of personal data if such data is processed unlawfully or is inaccurate;
- protection of my personal data from unlawful processing and accidental loss, destruction, or damage due to intentional concealment, failure to provide, or untimely provision thereof, as well as protection from the dissemination of inaccurate information that damages my honor, dignity, or business reputation as an individual;
- file complaints regarding the processing of my personal data with the Ukrainian Parliament Commissioner for Human Rights or with a court;
- apply legal remedies in case of violation of personal data protection legislation;
- make reservations regarding the limitation of the right to process my personal data when granting Consent;
- withdraw my Consent to the processing of personal data;
- know the mechanism of automated processing of personal data;
- protection from automated decisions that have legal consequences for me.
Third Parties
I understand that, in order to provide certain services presented on the Website and in the Software Application on behalf of the Company, the Company may enter into agreements with third parties. To provide such services, third parties may require access to some or all of my personal data. In such cases, I agree to the transfer of my personal data solely for the purposes specified above and subject to the implementation of all reasonable measures to ensure secure and reliable data processing in accordance with applicable law.
In addition, I understand the need to collect and transfer to third parties (such as potential investors of the Company, affiliates, partners, and advertisers) statistical data on the use of the Platform via the Website and/or the Software Application, including data on traffic, user behavior, sales, etc. In such cases, I agree to the transfer of my personal data exclusively in anonymized form and in compliance with applicable law.
Term of Validity
This Consent is valid from the moment it is granted and throughout the entire period of my use of the Platform via the Website and/or the Software Application until the moment this Consent is withdrawn. During this period, the Company and other persons specified in this Consent are entitled to process, including store, my personal data specified in this Consent.
Withdrawal Procedure
I am aware that this Consent may be withdrawn by me at any time by sending a notice to the official email address of the Company’s legal department at [email protected]. In the event of withdrawal of Consent to the processing of personal data, I am informed of the necessity to cease using the Platform via the Website and the Software Application.
